These Terms and Conditions (“Terms”) govern your access to and use of this website and related online services (the “Site”) operated by Miyako Investments LLC, doing business as Most Built Construction LLC (“Company,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. Nature of Site; No User Accounts
The Site is an informational and marketing website for our business. It does not offer user account registration, membership accounts, dashboards, or ongoing user profile access. The primary interactive feature is the submission of inquiries or consultation requests.
We reserve the right to restrict, block, suspend, or terminate access to the Site or any portion of it at any time, for any reason or no stated reason, with or without notice, and in our sole discretion.
3. Permitted Use
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- misuse the Site or interfere with its operation
- attempt unauthorized access
- introduce malicious code
- use automated tools to scrape or harvest content or data without written permission
- submit false or misleading information
- impersonate any person or entity
- use the Site in any way that violates law or infringes the rights of others
4. Consultation Request Form Only
The Site may allow you to submit a consultation request, contact inquiry, or similar message. By submitting information through the Site, you represent that the information you provide is truthful, lawful, does not infringe or violate the rights of any person, and does not contain unlawful, threatening, fraudulent, abusive, defamatory, harassing, obscene, malicious, spam, or otherwise improper material.
We may reject, ignore, preserve, review, forward, disclose, or report any submission in our sole discretion, including to law enforcement, regulators, courts, legal counsel, vendors, technical providers, or other appropriate parties where reasonably necessary to investigate misconduct, prevent harm, protect rights, comply with law, or support legal proceedings.
5. No Contract, No Professional Relationship, No Obligation to Respond
Use of the Site does not create any contractor-client relationship, fiduciary relationship, agency relationship, advisory relationship, consulting relationship, or other professional relationship.
Submitting a contact form, requesting a consultation, sending a message, calling us, or otherwise communicating through the Site does not create a construction contract, bid acceptance, obligation to respond, obligation to keep information confidential, or duty to provide services.
Any construction, remodeling, repair, design, consulting, inspection, or related service must be governed by a separate written agreement signed by the appropriate parties.
6. Informational and Marketing Purposes Only
The Site and all content on it are provided for general informational, promotional, and marketing purposes only. Descriptions of services, projects, materials, timeframes, budgets, outcomes, visuals, renderings, examples, and other content are illustrative only. They are not guarantees, promises, warranties, fixed quotes, code determinations, permit determinations, engineering advice, legal advice, architectural advice, or project-specific recommendations.
Actual conditions, costs, scope, labor availability, material availability, permit requirements, and results vary.

8. Intellectual Property
The Site and its content, including text, layout, branding, graphics, project descriptions, logos, photographs, videos, design, compilation, and other materials, are owned by us, licensed to us, or used with permission, and are protected by applicable law.
You may not copy, reproduce, distribute, publish, display, transmit, modify, adapt, scrape, sell, exploit, or create derivative works from the Site or its content without our prior written permission, except for ordinary personal, non-commercial viewing.
9. Photos, Videos, and Project Portfolio Content
We may display construction-related photos, videos, and project portfolio materials for informational, branding, marketing, promotional, evidentiary, or archival purposes. We reserve the right to edit, crop, replace, remove, blur, caption, rearrange, or otherwise modify Site content at any time in our sole discretion.
If you submit any review, comment, testimonial, message, image, suggestion, or other material to us through the Site or in connection with the Site, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, adapt, publish, display, distribute, archive, and otherwise use that content for lawful business purposes, subject to applicable law.
10. Communications
If you contact us or provide contact information to us, you consent to receive communications from us related to your inquiry, consultation request, project screening, scheduling, follow-up, customer service, or business development, including by email, phone, and, where applicable, text message. Standard carrier charges may apply.
Your submission of contact information does not require us to respond, continue communications, or provide services.
11. Third-Party Tools and Links
The Site may contain links to third-party websites, platforms, maps, social media services, scheduling tools, analytics tools, embedded content, or other third-party services. We do not control and are not responsible for the availability, content, terms, privacy practices, acts, omissions, policies, or performance of any third party.
12. Site Availability
We may modify, suspend, discontinue, limit, or remove the Site or any portion of it at any time without notice. We do not guarantee that the Site will be uninterrupted, secure, current, complete, accurate, or error-free.
13. Disclaimer of Warranties
To the maximum extent permitted by law, the Site and all content, functions, information, materials, and services made available through it are provided “as is,” “as available,” and “with all faults.” We disclaim all warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, reliability, performance, and quiet enjoyment. We do not warrant that the Site will be available, uninterrupted, secure, free of harmful code, or error-free, or that defects will be corrected.
14. Limitation of Liability
To the maximum extent permitted by law, Miyako Investments LLC, dba Most Built Construction LLC, and its owners, members, managers, officers, employees, agents, representatives, affiliates, subcontractors, vendors, licensors, successors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for any loss of data, loss of use, business interruption, reputational harm, or cost of substitute services, arising out of or related to the Site or these Terms, even if advised of the possibility of such damages. Our total aggregate liability shall not exceed one hundred U.S. dollars (US $100).
15. Indemnification
You agree to defend, indemnify, and hold harmless Miyako Investments LLC, doing business as Most Built Construction LLC, and its owners, members, managers, officers, employees, agents, affiliates, subcontractors, licensors, vendors, successors, and service providers from and against any claims, demands, disputes, liabilities, damages, judgments, losses, fines, penalties, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site, your violation of these Terms, your violation of law or third-party rights, or any information or content you submit.
16. No Waiver
Our failure to enforce any part of these Terms is not a waiver of any right or provision.
17. Severability
If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted, and the remaining provisions shall remain in full force and effect.
18. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Except to the extent a valid arbitration provision applies, any dispute arising out of or relating to the Site or these Terms shall be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the jurisdiction and venue of those courts.
19. Optional Arbitration and Class Action Waiver
Any dispute, claim, or controversy arising out of or relating to the Site or these Terms may, at our election, be resolved by binding individual arbitration in San Diego County, California, except that either party may bring an eligible individual matter in small claims court.
To the maximum extent permitted by law, all claims must be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, representative, or private attorney general action.
If any part of this section is found unenforceable, the remaining provisions of these Terms shall remain in effect to the maximum extent permitted by law.
20. Changes to These Terms
We may update these Terms at any time by posting a revised version on the Site. The revised Terms become effective as of the posted Effective Date. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms to the fullest extent permitted by law.
